Terms of service
TheParty.day helps you make party invitations, send them to your guests and collect their replies. These terms are the agreement between you and us. We’ve kept them short and plain. Please read them before you buy.
Last updated: 31 October 2026
Draft: these documents are being reviewed by our lawyers before TheParty.day launches, and may still change.
01Who we are

Who sells to you depends on how you pay. Purchases in shekels (₪) are sold by the service operator. Purchases in any other currency are sold by Creative Cutz Toronto, Toronto, Ontario, Canada. The seller is shown at checkout and on your receipt.
02Who can use it
- You must be 18 or older to open an account or buy.
- TheParty.day is for parents and other adults planning a party. Children don’t open accounts. A parent or another adult enters any details about them.
- Keep your sign-in details safe. You’re responsible for what happens in your account, including by anyone you invite to help you manage your party.
03Plans and prices
- The Free plan costs nothing. Paid plans and add-ons are a one-time payment per party. There’s no subscription and nothing renews.
- Prices in shekels include VAT.
- Prices in Canadian or US dollars are shown before tax. Any sales tax (such as GST/HST) is added at checkout, and the total is shown before you pay.
- Buyers outside Israel and Canada pay in US dollars. A price shown in another currency is for information only.
- You can upgrade at any time and pay only the difference.
- We may change prices and plans for future purchases. A change never affects a party you’ve already paid for.
- TheParty.day doesn’t collect money gifts for hosts at the moment.
04Automated messages
- Paid plans include a number of automated messages, and you can buy more in message packs. One invitation or reminder sent to one household, by one channel (WhatsApp, SMS or email), is one message.
- We don’t count a message we don’t send, for example to a guest who has opted out.
- Delivery also depends on WhatsApp, phone carriers and email providers. We can’t promise that every message arrives or that every guest replies.
- The Free plan has no automated messages: you share the invitation link yourself.
05Sending invitations
- You’re responsible for the guest details you add, and for having permission to message each guest. You confirm this before your first send.
- Your invitations are personal, not advertising. Don’t use them to promote anything (see the acceptable use policy).
- Automated messages go out from TheParty.day’s business accounts, only between 09:00 and 21:00 in each guest’s local time, and never to a guest who has opted out.
- When you share from your own phone, you send the message yourself. We only prepare the text and the link.
06Cancellations and refunds
Cancellations and refunds follow our refund and cancellation policy, which is part of these terms. In short: you can cancel within 7 days of buying (14 days in Israel, the EU and the UK), as long as no invitations have been sent. In Canada, the US and elsewhere, the card processing fee is deducted from the refund. Once your invitations have gone out, the service has been delivered.
07Your content
- Your texts, photos and guest details stay yours. You give us permission to store, show and process them only to provide the service.
- You confirm you have the right to use what you upload, including permission from a parent or guardian for any photo of a child.
- We may remove content that breaks the acceptable use policy.
08Designs and AI
- The designs, artwork, animations and code of TheParty.day belong to us or our licensors. You may use them for your own party, not elsewhere.
- Some features use AI. AI suggestions and AI-made images may not be perfect, so check them before you send. Nothing goes to your guests without your approval.
09Availability and responsibility
- We work hard to keep TheParty.day running and accurate, but it’s provided as is. We can’t promise that the service is never interrupted.
- As far as the law allows, we’re not responsible for indirect losses, and our total responsibility for a party is limited to what you paid for it.
- Nothing in these terms limits rights you have under consumer law that can’t be excluded.
10Ending your account
You can delete your account at any time. We may pause or close an account that breaks these terms or the acceptable use policy.
11Changes to these terms
We may update these terms. If a change matters, we’ll email you at least 30 days before it applies, saying what changes. A change never applies to a purchase you’ve already made without your agreement.
12Law and courts
- Purchases in shekels: Israeli law, and the competent courts in the district of the Israeli company’s registered office.
- All other purchases: the law of Ontario and the federal law of Canada that applies there, and the courts of Toronto, Ontario.
- If you’re a consumer, you keep the protection of the mandatory consumer laws where you live, and you may go to your local courts where that law allows (for example in Quebec, the EU or the UK).
